SYNOPSIS
It is essential that cosmetic brands understand the regulatory framework in which their product developments are classified. More often than not, brands can find themselves facing a dilemma when it comes to such categorisations. A number of cosmetic products will overlap with either medicines, medical devices, foods, toys and biocides. In the EU this overlap is termed ‘borderline’, especially when the classification of a ‘cosmetic’ product is unclear. This means that brands need to be aware of the regulatory requirements of each of these categories when it comes to defining their ‘cosmetic’.

This presentation will cover the meaning of borderline cosmetics in terms of definition, and definition within the context of cosmetic ‘claims’; the categories and types of borderline cosmetics and how they cross-over with other legislations; what case-by-case basis means; functions of a product versus claims; the need for robust evidence and how evidence may or may not be considered; misleading consumer perceptions; and examples of case studies.

BIOGRAPHY
Theresa Callaghan is a PhD biochemist with postdoctoral experience from the Pasteur Institute Paris, from where she entered the cosmetics and personal care industry. With over 35 years of international experience, she has held senior R&D roles at companies including LVMH, Unilever, J&J and proDERM. In 2008, she founded Callaghan Consulting International in Germany, focusing on cosmetic claims discipline and scientific advancements.

As a prolific writer and member of scientific editorial boards, she has penned over 150 publications and contributions to leading journals and magazines in cosmetic science. She authored Help! I’m Covered in Adjectives: Cosmetic Claims & The Consumer, recently published in a second edition.

Theresa also serves on the editorial board of the International Journal of Cosmetic Science and HPC Today, and is active in professional societies including the British Herbal Medicine Association. She mentors, advises TKS Science Publisher, writes monthly columns for Euro-Cosmetics Magazine on Claims Insights, where she is also a Scientific Editor, and writes monthly on ingredient technologies for BEAUTY STREAMS. Her extensive expertise and contributions have made her a valuable specialist in the industry.
